Florida Penalties for Aircraft Piracy are Strict
Here in Florida, prosecutors and courts treat aircraft piracy very seriously. Florida statute 860.16 states that aircraft piracy is the unlawful seizure or control of an aircraft containing at least one nonconsenting person “by force or violence and with wrongful intent.” Aircraft piracy is a first degree felony in Florida, and is punishable by up to 30 years in prison and a maximum fine of $10,000.
We Provide Legal Assistance if Your Aircraft Piracy Offense is Tried in Federal Court
Aircraft piracy can also be tried in federal court, meaning that you will be up against the full backing of the federal government. Federal prosecutors will seek the harshest punishment possible, and will have virtually unlimited resources and clout at their disposal. For this reason, you need a law firm capable of mounting a worthy defense strategy. Below is the definition of federal aircraft piracy:
- As per 49 U.S. Code § 46502, Aircraft piracy is “seizing or exercising control of an aircraft in the special aircraft jurisdiction of the United States by force, violence, threat of force or violence, or any form of intimidation, and with wrongful intent.” The minimum prison sentence for this crime is 20 years in prison. And, if another person dies because of the defendant’s acts, the punishment shall be life in prison or the death penalty. Furthermore, attempting to commit this offense or even conspiring to commit aircraft piracy faces the same 20-year minimum prison sentence.
